Minors in Title

Question: What to do if you come across a minor in title?

Answer: Refer to Starslink - Statutes of Limitations for Judgments, Liens & Title Matters – a Chart

On Page 3 appears the following information:

• Incompetent Persons, including minors (Persons Under Disability). Va. Code § 8.01-67, et. seq.

• During time of disability (incompetency or minority).

• Age of majority is Eighteen (18). Property of incompetents may be held in trust, OR a durable power of attorney used (not applicable to minors), OR guardian ad litem must be appointed to represent the interest of the incompetent person.
